An Employee Resigned And Retracted Her Resignation Letter. She Resigned Again And I Refused To Let Her Retract Her Resignation Letter Again. Am I Within My Right To Do So?

Once an employee submits a resignation letter to their supervisor, it does NOT have to be retracted.  Now there may be circumstances that have made her change her mind.  It is only the supervisor's peragotive to allow the employee to retract her resignation letter.  From you question, it appears as though the supervisor as already allowed her to retract the resignation one time already.  For the supervisor to allow it a 2nd time would be very unprofessional.  This situation should definitely be communicated to your Human Resources' Department.

I have a question relating to this.  We have recently offered a candidate.  The candidate originally accepted the role, but then due to a counteroffer, turned the offer down and retracted his resignation in writing.  We have counteroffered in response and the candidate has accepted our new terms and wants his original notice to still stand so he can join us on the originally agreed date.  What is the legal situation if he asks his current employer to heed the original notice letter and date and cancel his retraction?
